ANUPHEAP: refers to smartphone application available on Apple App Store and Google Play Store and can be operated by you to serve the intended purposes as intended by BVM.
BVM/BVM Petroleum: refers to Bright Victory Mekong Petroleum Import Export Co., Ltd.
Account: refers to account available in ANUPHEAP by default after you have registered with ANUPHEAP. Accounts can be used to store petroleum product in liter metric unit.
Notifications: refers to message sent to you with the intension to notify you of general alert or any alert related to activities perform on ANUPHEAP via SMS, Email, and in-app push-notifications.
Refuel: refers to the act of supplying more fuel to a vehicle/engine that operates on fuel.
QR Code: refers to quick response code in matrix barcode format, which can be scanned to make payment, redeem fuel, or retrieve information.
General User: refers to individual fuel consumer who generally buy fuel as part of personal energy consumption.
Corporate User: refers to entity who buys then offers fuel as part of their staff benefit package or buys fuel to cover operational fuel requirement in the entity.
Station User: refers to authorized user at BVM standard stations.
Settlement: refers to the process of exchanging fuel balance from Station owner’s Account to cash with BVM.
Make Payment: redeems for fuel to refuel your vehicle in exchange with fuel balance in user’s ANUPHEAP account.
BVM standard station refers to BVM’s owned and operated petroleum station.
Risk Management Measure: refers to action done by BVM to ensure that ANUPHEAP user is protected from any risk that may lead to certain consequences.
Customer, user, you, your, yours: refer to ANUPHEAP account’s holder
ANUPHEAP, BVM, BVM Petroleum, we, us, our, ours: refer to Bright Victory Mekong Petroleum Import Export Co., Ltd.
These Terms and Conditions govern your use of the mobile application namely “ANUPHEAP” provided by Bright Victory Mekong Petroleum Import Export Co., Ltd (BVM). As a user of ANUPHEAP, please read these Terms and Conditions carefully. By accessing for and using ANUPHEAP you agree to be bound by the Terms and Conditions.
By checking the radio button next to the term stated: “I’VE READ AND AGREED TO THIS TERMS AND CONDITIONS” and proceed by clicking “Next”, you confirm that you have fully read, understood, and accepted these Terms and Conditions.
BVM reserves the right to change or modify these Terms and Conditions (including our policies which are incorporated into these Terms and Conditions) at any time. You will be notified by the notification feature within the application when there are changes or modifications made to the Terms and Conditions.
1.1. ANUPHEAP is designed to provide conveniences and new experience of buying fuel, managing fuel consumption, and refueling at the pump. Features and functionalities of the application shall be modified and updated to bring about more benefits to ANUPHEAP’s user.
1.2. Key features of ANUPHEAP for General User include:
a. View fuel rate.
b. View fuel balance in the account and account transaction detail.
c. Purchase fuel.
d. Transfer fuel to friends and family members.
e. Creates favorite users for easy fuel transfer.
f. Scan QR to make payment at any BVM standard stations when refueling or redeem fuel from QR Code sent to you by another user.
g. Read useful news related to oil industry or and information from BVM.
h. Search for BVM standard stations near you.
i. Get alert when you are located within 5KM radius of a BVM standard station.
j. Receive and view notifications in ANUPHEAP.

1.3. Key features of ANUPHEAPfor Corporate User include:
a. View fuel rate.
b. View fuel balance in the account and account transaction detail.
c. Make purchase request for fuel.
d. Disburse fuel allowance to eligible employees within the corporation.
e. Read useful news related to the oil industry and/or information from BVM.
f. Search for BVM standard stations near you.
g. Receive and view notifications in ANUPHEAP.

1.4. Key features of ANUPHEAP for Station User include:
a. View fuel rate.
b. View fuel balance in the account and account transaction detail.
c. Request settlement with BVM.
d. Clear balance from station counter account to station main account.
e. Read useful news related to the oil industry and/or information from BVM.
f. Search for BVM standard stations near you.
g. Receive and view notifications in ANUPHEAP.

1.5. Key features of ANUPHEAP for Station Counter User include:
a. View fuel rate.
b. View fuel balance in the account and account transaction detail.
c. Generate QR Code for General User to scan (make payment when refueling).
d. Read useful news related to the oil industry and/or information from BVM.
e. Search for BVM standard stations near you.
f. Receive and view notifications in ANUPHEAP.
Refers to appendix 1 for detail features in ANUPHEAP.
User is eligible for using ANUPHEAP when:
2.1. You have an eligible smartphone with a valid and active mobile phone number.
2.2. You have installed the ANUPHEAP and registered as ANUPHEAP user with your personal mobile device.
2.3. You log into ANUPHEAP with your own user using your own personal device registered with ANUPHEAP.
2.4. Your device’s operating system is genuine (not jail-broken).
2.5. For your security purposes, you acknowledge that BVM reserves the right to reject your request for ANUPHEAP log in or activation when necessary. In such an event, BVM’s Call Centre can be contacted to address your concern.
BVM reserves the right to set and change limitations on the transaction amount, condition, and other matters at any time without giving prior notice. Such changes will be made as part of our risk management measure. Refers to appendix 2 for detail on transaction limit.

BVM shall not be liable to a customer for unavailability, failure, interruption, suspension, or delay in the operation of any ANUPHEAP’s function or features incurs due to connectivity issue, which is out of BVM’s reasonable control.
3.4.1. BVM may add or disable any features or suspend the operation of ANUPHEAP or any of its services at any time for the purpose of carrying out periodic maintenance and any administration task, or for the purpose of mitigating any security threat toward the full or part of ANUPHEAP system.
3.4.2. ANUPHEAP will have frequent releases of new versions to bring new features and improvements, as well as updated operating systems. You must update and use only the most up-to-date version of ANUPHEAP.
3.4.3. For security purposes, BVM may force its users to update ANUPHEAP to the latest version from time to time. You might not be able to continue using an old version of ANUPHEAP unless you update to the latest version.
4.1. In order to protect your Account’s Security Credentials and Personal Information, user must take responsibility to prevent any unauthorized use and access to ANUPHEAP on your device as following:
a. Ensure that your Security Credentials to access ANUPHEAP remain confidential to you alone and that you take all reasonable steps to prevent them from being disclosed.
b. Not let any other person unlock your mobile device or store their Biometric Identifier on ANUPHEAP or your mobile device.
c. Not leave your mobile device unattended while you remain logged in to your account(s) or ANUPHEAP and ensure that no-one else can see you enter your Security Credentials.
4.2. You must notify BVM team immediately upon being aware that:
a. Your mobile device is lost or stolen.
b. Another person may be able to unlock your mobile device or ANUPHEAP.
c. There has been unauthorized access to your account(s) accessible via ANUPHEAP.
4.3. You must install only ANUPHEAP on your mobile device via App Store or Google Play Store, and you will not override the software lockdown on your mobile device (i.e., jailbreak or root your mobile device).
4.4. You must promptly update, and keep updated, the operating system and security software for your mobile device when released by your mobile device manufacturer or mobile device operating system provider.
4.5. Before you sell or permanently give your mobile device to any person, you must delete the ANUPHEAP and all your Biometric Identifiers (e.g., TouchID or FaceID) registered in the device.
4.6. One user, one device; to ensure the fair usage of the application and prevention of any unauthorized access or misuse of the user accounts, sharing of account information or using the application on multiple devices simultaneously is strictly prohibited. Failure to comply with this condition may result in the suspension or termination of the user’s account.
4.7. Subject to the eligibility of your mobile device, you may choose to enable biometric authentication to log on to or authenticate any ANUPHEAP transaction. In such case, ANUPHEAP will be using biometric identifier, which is stored on your mobile device only.
4.8. In any case that another person has stored their biometric identifiers on your mobile device (used to access or perform transaction on ANUPHEAP), BVM will treat the access or the authorization as being conducted with your knowledge and consent.
5.1. ANUPHEAP is a free to use mobile application. We reserve the right to vary and amend the fees and charges at any time with notification to the user.
5.2. The user may incur charges from mobile or internet service provider. Such charge, if any, shall be born under user’s responsibility and any matter with regards to those charges shall be raised to your mobile or internet service provider.
6.1.1. Prices are subject to change. The Products prices that we display on ANUPHEAP is complied with the price announcement made by Ministry of Commerce of the Kingdom of Cambodia.
6.1.2. You can pay for your purchase using payment methods offered on ANUPHEAP, which are offered by banks that are our partners, or other payment methods we offer from time to time. KHR – USD currency exchange rate to be applied, in case:
a. Customer purchases the product using USD bank account, the USD price should be used for settlement.
b. Customer purchases the product using KHR bank account, the KHR price should be used for settlement.
6.1.3. Your fuel balance is subject to adjustment, when the price announced by Ministry of Commerce of the Kingdom of Cambodia differs from the price set on the day you purchased the fuel, in accordance to the actual monetary equivalent amount you have spent to purchase the fuel via ANUPHEAP.
6.1.4. You must ensure that you have sufficient funds in your bank account to make payment for your purchase.
6.2.1. When initiating any type of fuel transfer, you will be required to provide certain information about the recipient, which will vary depending on the type of transfer.
6.2.2. When making a fuel transfer, ANUPHEAP will display the name of the recipient for the sole purpose of assisting you in identifying the recipient of the transfer only. You agree not to share or disclose the recipient’s name to any third parties. In case you share or disclose the receipt’s name to any third parties, you will be liable for any damage or loss (including consequential loss and regulatory fines) which results from your sharing or disclosure of the recipient’s name and account number to any third party.
6.2.3. You agree that ANUPHEAP can disclose your name to any person attempting to initiate a fuel transfer to you from their ANUPHEAP Account in time that they input your Phone number, even when the transfer may not be completed.
6.2.4. General user type will be able to initiate transfer of fuel from any of their account to another general user account as below:
a. Transfer to specific recipient.
b. Transfer to non-specific recipient (via QR Code).
6.2.5. When you transfer fuel to a non-specific recipient, the QR Code and Claim Link will be generated. You can then share the QR Code along with the link via email or any messaging applications to the recipient. In case the recipient does not redeem within 24 hours, the balance will be reversed back to your account.
6.2.6. The transfer feature in ANUPHEAP shall not be used in any other legal/prohibited or illegal purpose besides transfer of fuel to friends and family.
You agree to have your Account listed and displayed when you scan a QR code with ANUPHEAP to make payment of your refueling to a BVM standard station. With certain validation, certain ineligible accounts are not displayed for choosing.
Any KHR – USD conversion in any transaction in ANUPHEAP shall be reasonably determined by BVM at its sole discretion. ANUPHEAP displays the exact equivalent amount of currency to be charged to your bank account. You agree to the exchange rate that is applied on the transaction, when you confirm/authenticate the transaction.
6.5.1. SMS / Email Notification
a. You agree that, by registering for ANUPHEAP, BVM may send or be requested to send an SMS to your mobile device or Email to your Email inbox.
b. BVM is not liable for any loss or damage you suffer as a result of any person other than you are accessing those SMSs, Emails and their content as a result of your negligence.
c. You may incur charges from your Mobile Operator as a result of using ANUPHEAP, SMSs, or Emails. Any such charges are solely your responsibility.
6.5.2. In-App Push Notification
a. You agree to receive alerts or Notification for your ANUPHEAP Account for certain Transaction or for marketing communications or announcements from BVM or Online survey form.
In order for certain features to work, ANUPHEAP will require location tracking on your mobile device to be turned on. You agree that you will allow ANUPHEAP to track your location when using such features.
7.1. You acknowledge that you are responsible for and must take all reasonable care to ensure that information you supply via ANUPHEAP is true, complete, accurate and up to date.
7.2. You must not use ANUPHEAP for any purpose (legal or prohibited/illegal) other than to undertake legitimate fuel consumption related transaction. You are legally entitled to operate in accordance with the Specific Terms and Conditions and the terms and conditions applicable to you.
7.3. If you use photos to personalize your accounts that can be accessed using ANUPHEAP, you warrant that:
a. The photos used by you do not contain any offensive or illegal content, or would be considered unacceptable for viewing by a person under 18 years old.
b. You took the photo (or are the owner of the copyright in the photo).
7.4. You must not act fraudulently or maliciously in relation to ANUPHEAP or software. As examples, you must not copy, modify, adversely affect, reverse engineer, hack into or insert malicious code into ANUPHEAP or software.
8.1. You acknowledge that any unauthorized reproduction by you of any proprietary information provided or available via ANUPHEAP or any portion of it may result in legal action being taken.
8.2. You will be liable for any loss suffered by BVM (including consequential loss) which results from your fraud or negligence, or your violation of the Specific Terms and Conditions.
9.1. BVM has no liability for any fuel transfers or payments in fuel to Station made by Scan QR service in ANUPHEAP if you decide to ask for refund because, in any case, you no longer want the goods.
You agree to indemnify and hold us harmless from any claims, damages, expenses, or liabilities arising out of your use of our application or your violation of these terms and conditions.
10.1. You may cancel ANUPHEAP usage at any time by notifying BVM in writing, by phone, or via ANUPHEAP. You will remain responsible for any transactions made on your account/s using ANUPHEAP up until the time at which such cancellation becomes effective.
10.2. BVM reserves the right to terminate, suspend or delete your account and access ANUPHEAP for any reason, including (but not limited to) where BVM is of the opinion that you have acted in breach of the Terms and Conditions.
In accordance with Cambodia’s regulatory requirements and BVM’s internal policies, you agree and consent that:
a. ANUPHEAP may collect Personal Information from you; you provide warrantee and assurance that Personal Information disposed by you through ANUPHEAP is true, complete, and up to date.
b. Personal Information collected as part of your identity can be held by BVM for the purpose of enabling you to use the services provided by BVM.
c. BVM can collect any information on your usage behavior for the purpose of security enhancements and user experience improvements.
d. BVM may require that location tracking be enabled on your mobile device so that some specific features in ANUPHEAP can work.
BVM owns or has obtained a valid license to use all intellectual property used in connection with the provision of ANUPHEAP. Information provided to you as part of ANUPHEAP may only be used for personal use and reference only and may not be reproduced, distributed, or transmitted to any person or incorporated into any other document without BVM’s prior written consent.
BVM reserves the right to amend the Terms and Conditions at any time. The amended Terms shall be effective immediately upon posting. It is your responsibility to check the Terms regularly. Your continued use of our application after any such changes shall constitute your acceptance of the modified terms and conditions. If you do not agree with the amended Terms, whether in whole or in part, you must stop using the Platform immediately.
These Terms and Conditions shall be governed and construed in accordance with the laws of Cambodia. BVM and user shall attempt in good faith to resolve any dispute or claim arising out of or in relation to this Agreement, including any question regarding the Terms and Conditions through negotiations between representative of each of the Parties with authority to settle the relevant dispute. If the dispute cannot be amicably settled within thirty (30) calendar days from the date on which either Party has served written notice on the other of the dispute, then the dispute shall be referred to and finally resolved by arbitration in the Kingdom of Cambodia in accordance with the Arbitration Rules of the National Commercial Arbitration Center (NCAC) being in force at the time of commencement of arbitration and by reference in this clause the NCAC Rules are deemed to be incorporated as part of this Terms and Conditions. The Tribunal shall consist of one arbitrator. The language of arbitration shall be Khmer.
Our application is provided “as is” and “as available” without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our application will be uninterrupted, error-free, or free from viruses or other harmful components.

A – General User
Profile Selection
Profile Selection allows the user to switch between different user type in case user has more than one user registered under the same phone number. For example: you can switch between Station User and General User, if you have both users registered with ANUPHEAP.
Fuel Rate
Fuel Rate displays price per liter of product available on ANUPHEAP, namely Diesel, EA92Regular Gasoline (Regular 92), and EA95Premium Gasoline (Super 95).
Upgrade Your Account
Upgrade Your Account allows users to upgrade their personal information so that they can access full features of ANUPHEAP.
Your Fuel Balance
Your fuel balance display accounts are available for each product type. In this feature, you can:
· See balance in liter within each account.
· See, browse through, and filter transaction details in each account.
· Buy more fuel for each specific account (product).
· Transfer fuel from each specific account (product).
· Export transaction detail in different file format.
Available Services
Purchase
Purchase allows user to purchase available products of fuel. Purchased fuel will be kept in the respective account (for the product purchased). Payment of fuel to be purchased will be made through integration between bank account of below banks:
· Advanced Bank of Asia Ltd (ABA Bank)
· AMK Microfinance Plc (AMK)
Transfer
Transfer allows users to make transfer of fuel balance in their account. User can:
· Transfer to specific recipient who is also another user of ANUPHEAP using just their registered phone number.
· Transfer to any recipient via generation of QR code. You can send QR code to the intended recipient via any messaging App. The recipient can redeem fuel you send to them by using ANUPHEAP.
Favorite
Favorite allows user to add family members or friends for easy access for fuel transfer in the future.
Scan QR
Scan QR allows user to scan ANUPHEAP related QR for:
· Making payment when refueling at BVM standard stations.
· Redeem fuel QR sent from a sender. Fuel will go to respective account based on the product sent, which is encrypted in the QR Code itself.
News
News allows user to read news related to oil industry and any other announcement related to ANUPHEAP and BVM.
Our Station
This feature requires that you turn on your Location Sharing. Our station allows user to:
· Know BVM standard stations closest to you. For your conveniences, you will see Our Station icon will change shape when you are located within 5KM radius of a BVM standard station.
· See all BVM standard stations and services available for each station.
· Search for location of BVM standard stations by different filtering options.
· Get directions to any of BVM standard stations you prefer to find.

More allows user to know the current version of ANUPHEAP, which user has downloaded, and packs other features such as:

Available Services
Purchase Request
Purchase Request allows user to lodge purchase request of fuel. Users will be contacted by ANUPHEAP’s team within 2 working hours after the request is lodged.
Disbursement
Disbursement allows corporate user to disburse fuel balance from their account to list of staff compiled into group by the corporate.
News
News allows user to read news related to oil industry and any other announcement related to ANUPHEAP.
Our Station
This feature requires that you turn on your Location Sharing. Our station allows user to:
· Know BVM standard stations closest to you. For your conveniences, you will see Our Station icon will change shape when you are located within 5KM radius of a BVM standard station.

Available Services
Settlement
Settlement allows user to lodge request for settlement with BVM. Once the request is lodged, you will be contacted by ANUPHEAP’s team within 2 working hours.
Daily Clearance
Daily Clearance allows user to move all balance from all counter accounts to respected main station accounts. This is designed to clear daily transactions so that the station can start the next day with zero balance for each counter for easy reconciliation.
News
News allows user to read news related to oil industry and any other announcement related to ANUPHEAP.
Our Station
This feature requires that you turn on your Location Sharing. Our station allows user to:
· Know BVM standard stations closest to you. For your convenience, you will see Our Station icon will change shape when you are located within 5KM radius of BVM standard stations.
· See all BVM standard stations and services available for each station.
· Search for location of BVM standard stations by different filtering options.
